FSSAI Annual returns are required of every Food Business Operator who has been issued a State FSSAI or Central License and is engaged in manufacturing or importing food products (other than dairy products). The deadline for filing the annual return is 31 May or earlier each year, as per sub-clause 1, Clause 2.1.13 Food Safety and Standards Act (Licensing and Registering of Food Businesses) Regulations 2011. If your Food Unit meets both eligibility criteria, you must file the annual report.

  • FBO is granted a food State license or Central License.
  • FBOs are involved in Manufacturing, Exporting and Importing Food Products.

Last Date to File the Annual Return under FSSAI

Due Deadline: The last date to file annual fssai returns by manufacturing units for importers is 31 May. For example, FSSAI annual return is due for the financial year 2020-21 on 31 May 2021. The COVID-19 Pandemic impacted the deadline to file the annual return. However, the FBO can now furnish the return for FY2020-21 until 30 June 2021.

Prescribed FOR: The licensee submits an annual return on Form D-1 detailing each food item he handled in the past financial year. FSSAI makes it mandatory to submit an online Annual Return by Food Businesses starting from FY. 2020-21 vide notification No. 15(31)2020/FOSCOS/RCD/FSSAI dated 18 December 2020.

Note: Separate Annual Return for Each License

The annual return must be filed regardless of whether the applicant is located. FBOs with multiple licenses must file separate returns, i.e., each food unit. Different Food Business Operators can hold these Licenses.

Half-yearly return by FBO Manufacturing Milk & Mild Products

Food Safety and Standard Regulation permits licensees to file half-yearly returns if involved in the collection/handling/ manufacture of Milk and Milk Products. They will submit half-yearly returns within one calendar month of the end-of-the-half-year in Form D1 & D2, respectively.

Online Forming of Returns via FosCos Portal to FSSAI

Effective immediately after 2020-21, the FSSAI annual return can only now be filed online via the FosCos Portal. Below are the benefits of online filing FSSAI Returns.

Information in the Annual Return

All licensed FBOs involved in producing and importing food products must file an annual return. The manufacturer also includes any processor, repacked, relabeled or other person involved in food production. The online filing of returns is easy. The Food Safety Compliance System, FOSCOS, already contains the format for Annual Returns. These are the required information to be included in the Annual Return.

  • Name of FBO
  • Address of FBO
  • No License

Articulation showing amounts of food items dealt with/fabricated/imported and traded in Tons. This assertion will give the particular in the underneath classifications.

  • Name of the Food product handled/manufactured/ exported/imported.
  • Size of can/bulk/bottle/any other package (like P.P. or
  • Quantity in metric tones
  • Value
  • For Export/Import, additional information is required.
  • Name of country or port of export.
  • The Kg. of the quantity exported/imported
  • Rate per kg or unit packing F.O.B./C.I.F. Value
Exemption from Filing the Annual FSSAI Return

Food Business Operators are exempt from the requirement to submit annual returns if they have an FSSAI Registration Certificate.
Other businesses include distributors, wholesalers, retailers, stock, transporter, and food service.
This means that restaurants, grocery shops, canteens and fast food corners are not required by law to file an annual return.

Penalty if FSSAI Annual Return is not Filled

The penalty for not filing the return by 31 May each year is Rs 100 per calendar day. The penalty continues until the return file is made. To avoid any disruption or penalty to the food business, it is suggested that annual returns be filed.
